TLDEF, Immigrants' Rights and LGBT Groups Urge Homeland Security to Protect LGBT Immigrants' Rights in Detention Facilities

In a letter authored by Lambda Legal, TLDEF and other LGBT and immigrants' rights groups argued that lesbian, gay, bisexual and transgender immigrants and those with HIV experience gross mistreatment and abuse in immigration detention facilities.  The letter was written in support of civil rights complaints filed by the National Immigrant Justice Center that outline egregious civil rights violations in immigration facilities in nine states across the country.  

There are major problems in immigrant detention facilities across the country, including a failure to properly house LGBT individuals. Often they are placed in solitary confinement.  Transgender people are not housed in accordance with their lived sex.  They are denied medically necessary treatments for gender identity disorder, including access to hormone treatment. Detention facilities fail to meet standards for the treatment of HIV.

The letter urges DHS to create and implement protocols that 1) guide detention facilities on housing for LGBT detainees; 2) ensure medically necessary treatment for gender identity disorder; 3) adhere to clinical protocols for the treatment of HIV; and 4) protect LGBT individuals and people living with HIV from sexual, physical and mental abuse.
